fighting muffler ticket

Im woundering if anyone has any expeiance fighting and wining a inproper mufler ticket. I was driving my car to the shop today and got pulled over and got a 85 dollar ticket for inproper muffler. and the cop said it was auditably to lound. no meausement was taken just his opinion. And im not running a crappy ebay axale back on my car. i have a dot and carb aproved magnaflow catback witch is seposed to be street legal and i passed sound inspection for auto x last year.

any help would be great.

I have went to court a few times to fight "Dumb %^$#^" Like this and won each time.

Usually if the Cop does not show up - YOU WIN :D
If he does show up make sure:
A: You have a copy of the *rules* ( Highway traffic act ) concerning auditory requirements / limits.
B: Try and get some reputable place to do a sound check that you can bring in as evidence of compliance.

" Ralf - does CTC do anything related to suitability of exhaust as part of a Safety Check ? "
or just no leaks etc...


If you can spare a few hours and miss work - Do It !!!

Thanks, and dose anybody know what the legal limit is, i treied searching and couldnt find anything. and the act he sited on my ticket is 75(1) witch from my research reads "Every motor vehicle or motor assisted bicycle shall be equipped with a muffler in good working order and in constant operation to prevent excessive or unusual noise and excessive smoke, and no person shall use a muffler cut-out, straight exhaust, gutted muffler, hollywood muffler, by-pass or similar device upon a motor vehicle or motor assisted bicycle. '

and i have a resinator and glasspack design muffler. but through my understanding is still a "muffler" it is not a straight piped exhaust

and its almost a more on principle thing then the fine.
esp with the attitude the office gave me that i was just some stupid kid out to be street racing withc drives me craxy when i spend thousands of dollars a year in track fees to race leagally and only drive the car for racing and the odd sunday drive.

Hahah he got me last year in my miata on my way to work claiming I have an "illegal" muffler yup 85 big ones went to the court house got it off.... Still a hassle, he will hit u with everything get this that same pull over he hit me with a ticket cause my car was blue and was once red, and I had not yet got the ownership switched, well two weeks later he pulled me over again just to check for a recite on a muffler change and to check and see if my ownership had been switched... Guess someone has nothing else's better todo at 630am. I have a lot of respect for police and that there job isn't easy by no means. But really? Must be me, luck of the draw. Nothing to do with the car I'm driving :poed: Speeding. DUI. Improperlane change. These r valid reasons. A car that's a bit loud. Hmmm Sorry this frustrates me.

Lol, we've met a couple times. I wouldn't call him any names, but he does have a reputation for this kind of thing.

Where can I get a Hollywood muffler? :D
I was only pulled over once for noise. Turbo car (turbine tends to regulate noise) 3" system, cat and resonator.
Just as he was telling me what I was in for, a pair of Harleys went by.
I will never pay a noise infraction ticket until they're universally enforced.

Casey pulled me over a couple years ago in my subaru and gave me a ticket for a SUBARU performance exhaust that was manufacturered to meet the new vehicle noise requirements.

Anyways I had all my papers in order to fight it, and found out that he never filed the ticket... :roll:


Exterior Sound Level

2. Every vehicle, other than a motorcycle or a vehicle referred to in section 4, shall be so constructed that

(a) where tested in accordance with Annex 3 to ECE Regulation No. 51, Uniform Provisions concerning the Approval of Motor Vehicles Having at Least Four Wheels with regard to Their Noise Emissions, dated March 11, 1996, excluding the requirements of paragraph 3.2 of that Annex, the vehicle conforms to section 6 of that Regulation; or


(b) where tested in accordance with

(i) section 3 of Test Method 1106 — Noise Emission Tests (August 2005), the exterior sound level does not exceed 83 dBA when a value of 2 dBA is subtracted from the highest average sound level recorded during the test, in the case of a bus with a GVWR of more than 4 536 kg,


(ii) SAE Recommended Practice J986, Sound Level for Passenger Cars and Light Trucks (August 1994), or SAE Standard J1470, Measurement of Noise Emitted by Accelerating Highway Vehicles (March 1992), the exterior sound level does not exceed 83 dBA when a value of 2 dBA is subtracted from the highest average sound level recorded during the test, in the case of a bus, multi-purpose passenger vehicle, truck or incomplete vehicle fitted with a cab with a GVWR of more than 2 722 kg and not more than 4 536 kg, and


(iii) SAE Recommended Practice J986, Sound Level for Passenger Cars and Light Trucks (August 1994), or SAE Standard J1470, Measurement of Noise Emitted by Accelerating Highway Vehicles (March 1992), the exterior sound level does not exceed 80 dBA when a value of 2 dBA is subtracted from the highest average sound level recorded during the test, in the case of a passenger car regardless of its GVWR or any other vehicle with a GVWR of 2 722 kg or less.

Keep in mind this is for new vehicles - for used vehicles the only requirement under provincial law is "excessive or unsual" noise, IIRC. Oh and no hollywood, or straight-through mufflers...

Forget Harleys, I'll never pay a vehicle noise violation ticket while OC Transpo buses are around. I'll be outside the office having a conversation and will actually have to stop talking until the buses that stop across the street have pulled away. They are stupidly loud... stupidly as in they really don't need to be that loud!

And apparently they aren't supposed to be that loud! (Speaking of "excessive noise")

Friggen hell officer casey pulled me over a couple weeks ago and left me with a couple souvenirs too! Neither were moving violations either.


I guess the guy has it out for the car modding world, especially if he has a reputation too.

Don't listen to Mystake, he got a ticket for " Atrocious display of unpainted front bumper " and " Use of rotary engine on public roads" in his other car.

I don't have a truck :(
But he got me for digital insurance pink slip and front license plate in windshield - originally was in door pocket but got pulled over for that too, lol. Officer Burns told me it was ok to have it in my windshield which is where it was when Casey pulled me over.

I'm surprised he didnt go after my exhaust considering the entire tip was hanging past the bumper at the time, lol

Does anyone know what the methodology is for measuring the sound pressure level from the exhaust? More specifically, is the measurement taken at 1 meter from the exhaust tip? I have a Db meter and would be curious to see why my levels are like (they are whisper quiet to a fault). I could bring the meter to some of the solo II events if others are interested in have a measurement done.

In any case, 80Db isn't all that loud, I mean, it's practically reference level for most home theatres.

Oh, and I totally agree with the harley davidson comments. Nobody should receive a ticket until those guys are brought in line too.

Does anyone know the maximum sound level for CMP? I think it's over 80 Db.

On the MCO lapping day forms, they say 92dB, but when I was getting soundchecked last year, the guy holding the meter told me 100dB and I belted out 94.9dB of raspy, ear splitting noise.

Keep in mind that the measure is logarithmic, so 92dB is more than twice as loud as 80.

CMP is 101 at the sound check.

West is best, they don't bug you around here for noise lol

on a race weekend yes, but they apply for a special permit. My understanding is that "normal" days, you must meet the 92db limit.

Sometimes the guys are a bit lenient though...

If you want to be able to test the noise levels of your cars there are several apps out there for various smartphones. My buddy got one for his android so that we could measure the volume of one of our co-workers while he's on the phone. Believe it or not, I'm pretty sure he got into the 80's!
